Students
in this year-long, six-credit course are competitively selected by
faculty for this alternative dispute resolution advocacy clinic, and
are assigned, under faculty supervision, to negotiate, mediate and
arbitrate cases before the New York Stock Exchange, National
Association of Securities Dealers, National Futures Association, and/or
the American Arbitration Association. Students conduct all phases of
the securities arbitration assigned to them, including: case intake,
case development, discovery, settlement negotiation, mediation, and
representation of the claimants before the duly constituted arbitration
panels hearing their cases. The clinic is a unique opportunity to have
a hands-on experience and to develop client-relation and mediation and
arbitration advocacy skills.
Coursework includes study of the
fundamental principles of securities arbitration, an overview of the
state and federal securities and other laws relevant to typical
investor claims against broker-dealers and clearing firms, and
instruction on ethical issues and guidelines concerning all aspects of
the Clinic's practice.
